Privacy Policy

Capitalised terms shall have the meaning indicated in the Service Provision Regulations, unless otherwise indicated.

§1 Principal’s personal data

The controller of the Principal’s data to the extent resulting from the nature of the services provided is GRUPA ZNATURY Sp. z o.o. with its registered office in Katowice (40-156), al. Wojciecha Korfantego 138a, entered into the National Court Register under the number 0000347353 by the District Court Katowice-Wschód, 8th Commercial Division of the National Court Register in Katowice, capital: PLN 70,000, REGON (Statistical Identification Number): 241472991, NIP (Tax Identification Number): 2220872890 (hereinafter: Contractor).

The Contractor is the owner of the Globkurier.pl Transaction System, which is a platform between senders and carriers of goods.

The Contractor takes full care of security of the data provided, especially by securing it against unauthorised access.

In accordance with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and the repeal of Directive 95/46/EC (General Data Protection Regulation) (hereinafter: GDPR), the Contractor informs that the provision of data is voluntary, although it may be necessary for the proper performance of the services.

§2 Technical and address aspects

When logging into GlobKurier.pl system, data concerning IP address, domain name, type of Internet browser are collected, whereas in case of service order, these are Principal’s address, address of residence, phone number and others.

The data shall not be made available to external entities in any way (with the exception of passing the data in the form of name, surname (name) of the address to the relevant Carrier) subject to a situation requiring it, e.g. in the case of a control of the General Inspectorate for Personal Data Protection or in the case of a violation of the Contractor’s rights, attempted hacking or other action to its detriment.

The Principal gives consent and accepts the transfer of data to the entity handling payment transactions for the purpose of payment of the relevant fee for services on the rules established by such entities. The provision of this data by the Principal is not obligatory, but is a necessary condition for the performance of the service.

§3 Marketing aspects

The Principal agrees to receive marketing information from the Transaction System, in particular any questions in case of any doubts, information on changes to the Website, as well as advertising content, if the Principal has previously given an additional and optional consent to do so, in accordance with the provisions of Article 10 of the Act of 18 July 2002 on the provision of services by electronic means (Journal of Laws 2020 344 consolidated text) and Article 172 of the Act of 16 July 2004 on the Telecommunications Law (Journal of Laws 2022.1648 consolidated text). The consent referred to in the preceding sentence may be revoked by the Principal at any time.

§4 Contractor’s rights

The Contractor shall have the right without prior notice to delete or block the Principal’s account at any time without stating a reason.

The Contractor shall determine and amend the provisions of the Privacy Policy independently.

§5 Cookies

Some elements of the GlobKurier.pl website require acceptance of cookies, which are necessary e.g. to remember the necessary data when the Principal logs in. By using the Transaction System the Principal consents to the use of cookies.

Pursuant to Article 173 section 1 of the Telecommunications Act we inform that the entity storing information or gaining access to information already stored in a telecommunications terminal device with cookie files is the owner of the Transaction System.

The website does not collect any information automatically except for the information contained in cookies.

Cookies may also be placed and used by cooperating advertisers.

Cookies are stored for the following purposes:

  • maintaining the Website User’s session (after logging in), thanks to which the User does not have to re-enter their login and password or other data requested on each sub-page of the Website,
  • adapting the website to the individual needs of users,
  • creating website viewing statistics,
  • collecting information for the partner programme.

The following types of cookies are used on the Website:

  • ‘necessary’ cookies enabling the use of the services available on the Website, e.g. authentication cookies used for services requiring authentication on the Website,
  • cookies used for security purposes, e.g. used to detect misuse of the Website’s authentication procedures
  • ‘performance’ cookies, making it possible to collect information on how the Website’s pages are used,
  • ‘functional’ cookies, allowing to ‘remember’ the User’s selected settings and to personalise the User’s interface, e.g. with regard to the User’s chosen language or region of origin, font size, website appearance, etc,
  • ‘advertising’ cookies which make it possible to provide the User with advertising content more suited to their interests.

In many cases, the web browsing software (Internet browser) allows cookies to be stored on the Principal’s device by default.

Customers may change cookie settings at any time. These settings can be changed, in particular, in such a way as to block the automatic handling of cookies in the web browser settings or inform on their placement in the device each time. Detailed information on the possibility and methods of handling cookies is available in the settings of your software (web browser).

Restrictions on the use of cookies may affect some of the functionalities available on the Transaction Website.

§6 Information regarding personal data (GDPR)

Every data subject has the right:

  • to view, correct and delete their personal data,
  • to submit requests in electronic form regarding information about data and its processing,
  • to submit a complaint related to the processing of personal data to the supervisory authority, which in the Republic of Poland is the President of the Personal Data Protection Office.

In matters not regulated by the privacy policy, the provisions of the Civil Code and relevant acts of Polish law, as well as European Union law, in particular GDPR (Regulation 2016/679 of the European Parliament and of the Council (EU) of 27 April 2016 on the protection of natural persons in relation to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC) shall apply.

The contractor processes your personal data for the following purposes:

a) the performance of the services offered on the Transaction System,

b) the transfer of the Principal’s personal data to ING Bank Śląski S.A. (‘Bank’) in connection with:

  • the provision by the Bank to the Contractor of the service of making available the infrastructure for handling payments over the Internet (legal basis: Article 6, section 1(f) of the GDPR)
  • the handling and settlement by the Bank of payments made by Principals over the Internet using payment instruments (legal basis: Article 6, section 1(f) of the GDPR)
  • for the purpose of the Bank’s verification of the proper performance of the Agreements concluded with the Contractor, in particular to ensure the protection of the interests of payers in connection with complaints made by them (legal basis: Article 6, section 1(f) of the GDPR)

c) the transfer of the Principal’s personal data to Twisto Polska Sp. z o.o. in connection with the possibility of Twisto Polska Sp. z o.o. offering to make payment for the goods or services purchased by Twisto Polska Sp. z o.o. under a contract of mandate including the ‘Buy with Twisto’ purchasing formula and making this purchasing formula available through the Transaction Website, as well as for the purpose of verification by Twisto Polska Sp. z o.o. of the proper performance of such contracts of mandate (legal basis: Article 6 section 1(f) of the GDPR).
